By registering for this auction all Bidders agree that they have read and fully understand these terms and agree to be bound thereby.
EVERYTHING IS SOLD AS IS WHERE IS. SARPY COUNTY AND GREAT PLAINS AUCTION CO ASSUME NO LIABILITY.
Anyone who attends the open house, participates in picking up purchases or who otherwise enters the Sellers property in association with this auction must sign a WAIVER OF LIABILITY AND HOLD HARMLESS AGREEMENT. No one under the age of 18 may enter the property.

Auction company and Seller are not responsible for removing, preparing for shipping or shipping property purchased at this sale. Some equipment will require mechanical assistance for removal. Seller will assist with loading purchased items.

Items offered at the auction may be contained in or photographed with packaging which may not accurately depict the item. Packages and containers may be only partially full or empty. Buyers should review the auctioneers description as well as photos of the actual item and be guided by their own inspection. Measurements are approximate. Auctioneer will not be responsible for any errors or omissions in the description of the merchandise unless it is a material and intentional misrepresentation of the item itself.

Buyers must remove their purchases from the premises at their own risk, expense and liability. Purchases can be removed only upon presentation of the original paid invoice. Any personnel arriving to remove property must have government issued photo identification (such as drivers license) and prove they are the buyer, or have written, verifiable authorization from the buyer.
Items not picked up on schedule where no confirmed alternate arrangement with the Auction Company has been made, are subject to forfeiture.

Only Visa and Mastercard are accepted. The credit card the Bidder registered for the sale with shall be charged for purchases made by the Bidder with the following exceptions. Buyers who wish to pay in cash or debit card are required to notify the Auctioneer immediately after being notified by the Auctioneer of their successful purchase(s). Cash or Wire Transfer payment required for transactions of $5,000 or more. Credit card buyers will be charged a 4% convenience fee. A 15% Buyer premium will be charged on all purchases. A title preparation fee of $50 will be charged on each title prepared. No items to be removed before settled for.

This is an online auction only. All bids are in US Dollars. All lots will be sold to the highest Bidder regardless of price. Nebraska sales tax applies. Sales tax exempt bidders must email their sales tax exemption forms to [email protected] at time of registration. Auctioneer reserves the right to revoke any Bidder privileges for what the Auctioneer deems as unethical behavior. Bid with care, once a bid is placed, it cannot be retracted.

$1.00 to $50.00 $1.00
$50.01 to $500 $2.50
$501 to $5,000 – $5.00
$5,001 to $12,000 – $10.00
$12,001 and Over – $25.00

By placing an online bid, you are entering into a legally binding contract and agree to follow through with the purchase of the item should you win the item. Bidder expressly agrees not to stop payment, dispute or contest this transaction. The Seller and Auctioneer reserve the right to remove any and all items from the sale at any time. Bidder agrees to hold the Seller and Auctioneer harmless for the failure of an online bid to execute for any reason.

Buyer agrees to indemnify and hold harmless Auction Company and Seller from and against all claims and liabilities relating to the condition or use of the articles purchased or failure of user to follow instructions, warnings or recommendations of the manufacturer, or to comply with federal, state and local laws applicable to such articles or for proximate or consequential damages, costs or legal expenses arising there from.

All claims and disputes arising under or relating to this Agreement are to be settled by the Auctioneer according to the Auctioneer rights reserved herein with claims and disputes unresolved beyond that to be settled first by amicable negation and in the failure of negation by binding arbitration in the state of Nebraska rather than in court.
